Terms and Conditions
Generali Run The Sun – Ascona-Locarno-Marathon
1. Organiser
The Generali Run The Sun – Ascona-Locarno-Marathon is organised by the Associazione Maratona Ascona-Locarno (hereinafter referred to as the ‘organiser’).
2. Acceptance of conditions
By registering, the participant fully accepts:
- the official event regulations;
- these General Terms and Conditions;
- the Privacy Policy published on the official website.
Registration is personal and non-transferable unless otherwise specified by the organiser.
3. Registration and payment
Registration is only valid once the participation fee has been paid in full.
The organiser reserves the right to reject any registration that is incomplete or does not comply with these terms and conditions.
Registration may close early if the maximum number of participants for one or more races is reached.
4. Registration changes
Changes to registrations, distance changes, name changes or cancellations are governed by the conditions published on the official registration platform.
Any optional insurance services offered during the registration process are subject exclusively to the terms and conditions of the respective providers.
5. Participation
Each participant takes part in the event at their own risk.
The participant confirms that they are physically fit for the chosen distance and have no medical conditions or restrictions that would prevent them from taking part in the sporting activity.
The organiser recommends undergoing regular medical check-ups before participating in the event.
6. Safety
Participants are required to comply with the following:
- the official regulations;
- the course markings;
- the organiser’s instructions;
- the instructions given by volunteers;
- the requirements of the authorities and the instructions of the medical staff.
For safety reasons, the organiser, the medical service or the competent authorities may interrupt or terminate a person’s participation at any time.
7. Timing and rankings
The official rankings are based on the data recorded by the official timing system.
Only the results published by the organiser shall be considered official.
Any protests must be submitted in accordance with the procedures set out in the regulations.
8. Disqualification
The organiser reserves the right to exclude or disqualify participants at any time if they:
- use another person’s race bib;
- transfer their race bib to another person without authorisation;
- do not follow the official course;
- receive unauthorised assistance;
- endanger their own safety or the safety of others;
- engage in unsportsmanlike conduct or act contrary to the spirit of the event.
In the event of disqualification, the participant concerned forfeits any right to be included in the official rankings and to receive a refund of the participation fee.
9. Time limits and course changes
For organisational or safety reasons, the organiser may establish time limits, checkpoints or intermediate timing points.
Participants who exceed the established limits may be excluded from the official rankings or required to continue the race outside the official event organisation.
The organiser also reserves the right to modify, if necessary, the courses, schedule, distances or any other aspect of the event.
10. Insurance
Accident insurance and personal liability insurance are the responsibility of the participant.
The organiser does not provide any individual insurance coverage.
11. Liability
To the extent permitted by law, the organiser accepts no liability for:
- accidents;
- injuries;
- health-related problems;
- property damage;
- theft;
- lost property;
- damage caused to third parties.
Mandatory statutory provisions on liability shall remain unaffected.
12. Force majeure
The organiser may modify, postpone, interrupt or cancel the event if circumstances arise that are beyond its control, including:
- extreme weather conditions;
- natural disasters;
- epidemics or pandemics;
- safety concerns;
- orders issued by the authorities;
- extraordinary or unforeseeable events.
In such cases, there is no automatic entitlement to a refund of the participation fee.
13. Personal data
Personal data is processed in accordance with the applicable Swiss data protection laws and the Privacy Policy published on the official website.
14. Image and sound recordings
By registering, the participant grants the organiser and the official event partners free permission to use photographs, video recordings, television footage and other content created during the event for information, media, promotional and communication purposes.
This authorisation is granted without any limitation in time or territory.
15. Applicable law and place of jurisdiction
Swiss law shall apply exclusively.
The place of jurisdiction shall be Locarno, unless otherwise required by mandatory provisions of law.
